PLEASE READ CAREFULLY. THESE TERMS CONTAIN A BINDING ASSUMPTION OF RISK, A WAIVER AND RELEASE OF LIABILITY, A COVENANT NOT TO SUE, AN INDEMNITY, A LIMITATION OF LIABILITY, AND SEVERAL CONSENTS. BY BUYING A TICKET, REGISTERING, OR ENTERING THE FESTIVAL GROUNDS, YOU AGREE TO THEM, YOU GIVE UP IMPORTANT LEGAL RIGHTS (INCLUDING THE RIGHT TO SUE), AND YOU AGREE TO ASSUME ALL RISK OF INJURY, ILLNESS, DEATH, OR LOSS — INCLUDING RISK CAUSED BY THE NEGLIGENCE OF THE RELEASED PARTIES — TO THE FULLEST EXTENT PERMITTED BY LAW. IF YOU DO NOT AGREE, DO NOT BUY A TICKET AND DO NOT ENTER.
By purchasing a ticket to Bumi Festival 2026 (the “Festival”), completing registration, and/or entering the Festival grounds, you (the “Ticket Holder” or “you”) acknowledge that you have read, understood, and agreed to these Terms and Conditions (these “Terms”). These Terms apply to all ticket holders, participants, guests, volunteers, vendors, and visitors, and form a binding contract between you and Bumi Festival Ltd. (the “Organizer” or “Festival”).
CONDITION OF ENTRY: As a condition of entry, every attendee (and, for any attendee under the age of majority, that attendee’s parent or legal guardian) must also read, accept, and sign the Festival’s separate Waiver, Release of Liability, and Assumption of Risk. These Terms apply in addition to, and are not limited by, that Waiver; where both apply, the broader protection in favour of the Released Parties governs.
1. Definitions. In these Terms:
(a) “Applicable Law” means all applicable laws of the Province of Ontario and the federal laws of Canada applicable therein.
(b) “Claims” means any and all claims, demands, actions, causes of action, suits, proceedings, complaints, losses, damages (including direct, indirect, consequential, incidental, special, exemplary, and punitive damages), injuries, illnesses, death, liabilities, costs, expenses, fines, penalties, and legal fees (on a full or substantial-indemnity basis) of every kind, whether known or unknown, anticipated or unanticipated, present or future, and whether arising in contract, tort (including negligence), statute, equity, or otherwise.
(c) “Released Parties” means, collectively, the Organizer, Bumi Festival Ltd., and each of their respective past, present, and future parent, subsidiary, and affiliated entities, and their respective owners, officers, directors, principals, employees, staff, volunteers, contractors, subcontractors, suppliers, agents, representatives, sponsors, partners, performers, instructors, practitioners, exhibitors, vendors, security and medical providers, the owner, landlord, licensor, and operator of the Festival grounds, and the heirs, successors, and assigns of each of them.
(d) “Festival grounds” means the venue and all areas, structures, parking, camping, and adjacent areas designated by the Organizer as part of the Festival, and “attendance or participation” includes presence anywhere on or around the Festival grounds and travel to and from them.
2. Ticket Policy and Refunds. All ticket sales are final. Tickets are non-refundable under any circumstances, including illness, injury, change of plans, performer or programming changes, travel disruption, denial of entry or removal for breach of these Terms, severe weather, force majeure, or government orders. Tickets are non-transferable and may not be resold except through the Organizer’s official ticket-transfer system (if available). Tickets cannot be carried over to future editions of the Festival. The Festival is a rain-or-shine event. Nothing in this Section limits any non-waivable right you may have under the Consumer Protection Act, 2002 (Ontario).
3. Entry, Wristbands, Screening, and Search. All attendees must wear their official wristband or credential at all times; it is required for entry and re-entry. Lost, damaged, tampered-with, or shared wristbands will not be replaced and may result in denial of entry or removal without refund. You consent to screening and to the search of your person, bags, and belongings on entry and at any time on the Festival grounds, as a condition of entry. Security and the Organizer may deny entry to, eject, or confiscate any prohibited or unsafe item from, any person, at their sole discretion and without refund. Entry is a revocable licence that the Organizer may withdraw at any time.
4. Identification, Age, and Minors. All attendees must present valid government-issued photo identification on request. Any attendee under the age of eighteen (18) (a “Minor”) must be accompanied at all times by a parent or legal guardian, who must sign the Festival’s Waiver on the Minor’s behalf. A parent or legal guardian who brings, permits, or accompanies a Minor to the Festival does so on the express terms that the parent or guardian assumes all risk on the Minor’s behalf, agrees to these Terms on the Minor’s behalf and on their own behalf, and releases and indemnifies the Released Parties (including in respect of any Claim by or on behalf of the Minor) to the fullest extent permitted by Applicable Law. Certain areas or activities may be age-restricted and may require ID checks.
5. Assumption of Risk. You understand and expressly acknowledge that attendance or participation at the Festival is inherently and unavoidably dangerous and may result in property loss, illness, infection, minor or serious bodily injury, permanent disability, paralysis, or death. The risks include, but are not limited to:
(a) physical activity, movement, dancing, yoga, fitness, stretching, breathwork, bodywork, massage, and other wellness or movement activities;
(b) walking, standing, or gathering on uneven, natural, wet, slippery, crowded, or poorly lit terrain, and on temporary structures, stages, platforms, or flooring;
(c) camping, overnight stay, fires, cooking, and use of camp equipment;
(d) exposure to sun, heat, cold, rain, wind, lightning, dust, smoke, and other weather and environmental conditions;
(e) crowds, crowd surges, congestion, noise, amplified sound, strobe and other lighting, pyrotechnics, and special effects;
(f) the acts, omissions, negligence, or misconduct of other attendees, performers, vendors, practitioners, volunteers, and third parties;
(g) food, beverages, supplements, products, treatments, and services provided or sold by independent vendors and practitioners, including allergic reaction, foodborne illness, and adverse reactions;
(h) communicable and infectious diseases (including COVID-19 and other viruses, bacteria, and pathogens);
(i) the use of, or absence, delay, or failure of, first-aid, medical, security, power, water, sanitation, transportation, or other services or infrastructure; and
(j) travel, parking, transportation, and the loss, theft, or damage of personal property.
YOU FREELY, KNOWINGLY, AND VOLUNTARILY ASSUME ALL OF THESE RISKS AND ALL OTHER RISKS OF ATTENDANCE OR PARTICIPATION, WHETHER OR NOT KNOWN, FORESEEABLE, OR DESCRIBED ABOVE, INCLUDING RISKS THAT ARISE FROM OR ARE CONTRIBUTED TO BY THE NEGLIGENCE, BREACH OF CONTRACT, OR BREACH OF STATUTORY DUTY OF ANY OF THE RELEASED PARTIES, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW. You confirm that you are participating entirely of your own free will and for your own benefit.
6. Voluntary Participation, Fitness, and Health Decisions. You confirm that you are physically and mentally able to attend and participate, that you have no condition that would make participation unsafe, and that you will not participate in any activity beyond your own ability. You are solely responsible for your own health-related decisions and for monitoring your own condition, and you should consult your own physician before participating, particularly if you are pregnant or nursing, recovering from injury or surgery, or have any cardiac, respiratory, musculoskeletal, or other medical condition. You are responsible for any Minor, guest, or person in your care.
7. Communicable and Infectious Disease Acknowledgment. You acknowledge that the Festival is a public gathering and that any public gathering carries an inherent and elevated risk of exposure to and transmission of communicable and infectious diseases, including COVID-19. The Released Parties cannot and do not guarantee that you will not be exposed. You voluntarily assume all risk of exposure, infection, illness, and any resulting harm, and you release and will not sue the Released Parties in respect of any such exposure, infection, illness, or harm, to the fullest extent permitted by Applicable Law. You agree to comply with any health and safety measure the Organizer or any authority may require, and not to attend if you have symptoms of, or have recently tested positive for, a communicable disease.
8. Waiver, Release, and Covenant Not to Sue. In consideration of being permitted to attend and participate, you, on your own behalf and on behalf of your spouse, children, Minors and guests in your care, heirs, executors, administrators, estate, successors, and assigns, FOREVER WAIVE, RELEASE, DISCHARGE, AND GIVE UP any and all Claims that you have or may in future have against the Released Parties arising out of or relating in any way to your attendance or participation, EVEN WHERE SUCH CLAIMS ARISE FROM OR ARE CONTRIBUTED TO BY THE NEGLIGENCE, BREACH OF CONTRACT, OR BREACH OF STATUTORY DUTY OF ANY OF THE RELEASED PARTIES, to the fullest extent permitted by Applicable Law. You further COVENANT AND AGREE NOT TO SUE, COMMENCE, OR CONTINUE any Claim, action, or proceeding against any of the Released Parties in respect of any matter released by these Terms. This release applies to all Claims, whether known or unknown and whether presently existing or arising in the future, and you expressly waive the benefit of any law or rule that would otherwise limit a general release to Claims known at the time of signing. This release does not apply to liability that cannot, as a matter of Applicable Law, be released or waived (including liability for gross negligence to the extent the law so provides).
9. Indemnification and Defence. To the fullest extent permitted by Applicable Law, you agree to INDEMNIFY, DEFEND, AND HOLD HARMLESS each of the Released Parties from and against any and all Claims arising out of or relating to (a) your attendance or participation; (b) your acts, omissions, negligence, or misconduct; (c) the acts, omissions, or Claims of any Minor, guest, or person in your care; (d) your breach of these Terms or the Festival’s Waiver; (e) your violation of any Applicable Law or any posted rule or lawful direction; or (f) any harm, injury, or damage you cause to any person or property. Your obligation includes the duty to defend each Released Party, on request, with counsel reasonably acceptable to the Organizer, and to pay all legal fees and costs on a substantial-indemnity basis; alternatively, the Organizer may defend any such Claim itself and recover its full costs from you. You will not settle any Claim affecting a Released Party without the Organizer’s prior written consent. This indemnity survives the Festival.
10. Limitation of Liability. To the fullest extent permitted by Applicable Law, the total aggregate liability of the Released Parties to you arising out of or relating to the Festival or these Terms, regardless of the cause of action and whether in contract, tort (including negligence), breach of statutory duty, or otherwise, will not exceed the amount you paid for your ticket. In no event will the Released Parties be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for lost enjoyment, disappointment, travel, accommodation, time off work, or other costs. Each provision of these Terms that limits or excludes liability operates separately and survives even if any other provision is found unenforceable. Nothing in these Terms excludes liability that cannot be excluded under Applicable Law.
11. Consent to Emergency Medical Treatment. If you become ill or injured and are unable to consent, you consent to the Released Parties and emergency personnel arranging or administering such first aid, medical assessment, treatment, or transport as they consider reasonably necessary, and you agree that they are not liable for doing so or for declining to do so, and that you (or, for a Minor, the parent or guardian) are solely responsible for all resulting medical, ambulance, and related costs. A parent or guardian gives this consent on behalf of any Minor in their care.
12. Photography, Video, Likeness, and Media Consent. You grant the Organizer and its partners, sponsors, and designees an irrevocable, perpetual, worldwide, royalty-free, fully sub-licensable and transferable right and consent to photograph, film, and record you and to use, reproduce, edit, publish, distribute, and display your name, image, likeness, voice, and appearance, in any and all media now known or later devised, for promotional, archival, editorial, sponsor, commercial, and marketing purposes, without compensation, attribution, approval, or further notice. You waive any right to inspect or approve the finished materials and any claim (including for invasion of privacy, defamation, or right of publicity) arising from such use. Professional or commercial photography or filming by attendees requires the Organizer’s prior written approval.
13. Privacy and Communications Consent. You consent to the Organizer collecting, using, and disclosing your personal information for purposes related to the Festival, ticketing, safety, and communications, in accordance with the Personal Information Protection and Electronic Documents Act (PIPEDA) and the Organizer’s privacy practices, and to receiving Festival-related communications. You may withdraw consent to non-essential communications at any time.
14. Code of Conduct. The Festival is committed to a safe, inclusive, and respectful environment. Harassment, discrimination, violence, theft, intoxication, or other inappropriate or unsafe behaviour will not be tolerated. The Organizer may deny entry to, or remove, anyone who violates these Terms or any posted rule or lawful staff direction, without refund and without limiting any other remedy.
15. Prohibited Items and Activities. The following are strictly prohibited throughout the Festival grounds and surrounding areas:
(a) alcohol, illegal drugs, cannabis, or controlled substances;
(b) cooking equipment, personal campfires, open flames, smoke bombs, fireworks, or any flammable devices, except as expressly authorized by the Organizer;
(c) glass containers;
(d) weapons or dangerous objects;
(e) unauthorized vending, sampling, or solicitation;
(f) drones or unmanned aerial vehicles without prior written authorization;
(g) pets, except certified service animals supporting an attendee with a disability.
All food and beverages must be purchased from authorized vendors within the Festival grounds, except as the Organizer may otherwise permit.
16. Wellness Activities and Health. Wellness sessions and activities offered at the Festival (including yoga, meditation, movement, breathwork, and bodywork) are provided for general relaxation and well-being only and are not medical care, diagnosis, treatment, or advice. You participate at your own risk. The Released Parties are not responsible for, and do not endorse, any health-benefit, medical, or wellness claim made by any independent vendor, practitioner, or performer, and you rely on any such claim at your own risk.
17. Parking and Camping. All vehicles must park only in designated areas and display any required pass. Camping is permitted only in designated zones and is subject to all posted safety, fire, and quiet-hours rules. You camp, park, and store property entirely at your own risk, and the Released Parties are not responsible for any loss of or damage to vehicles or property.
18. Personal Property and Lost and Found. The Released Parties are not responsible for any lost, stolen, or damaged property at any time. You are solely responsible for your own belongings. Found items may be brought to the designated Lost & Found; unclaimed items may be donated or disposed of after the Festival.
19. Environmental Responsibility. The Festival is committed to protecting the land on which it is held. All attendees are expected to respect the environment: pack out what you pack in, dispose of waste in the correct recycling, compost, and landfill streams, do not damage trees, plants, or wildlife, and leave no trace.
20. Force Majeure. The Released Parties are not liable for any delay, interruption, curtailment, postponement, relocation, or cancellation of the Festival, in whole or in part, caused by circumstances beyond the Organizer’s reasonable control, including natural disasters, severe weather, fire, flood, epidemic or pandemic, public-health orders, government regulation, acts of war or terrorism, civil disorder, strikes, utility or infrastructure failure, or other emergencies. In such circumstances, ticket refunds (if any) are at the Organizer’s discretion and subject to Section 2.
21. Governing Law, Jurisdiction, Limitation Period, and Disputes. These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, and the courts of Ontario have exclusive jurisdiction, subject to any non-waivable right you may have. To the fullest extent permitted by Applicable Law, any Claim relating to the Festival or these Terms must be commenced within one (1) year after the event giving rise to it, after which it is conclusively barred, and any Claim must be advanced on an individual basis only and not as part of any class, collective, or representative proceeding.
22. Severability and Reading Down. Each provision of these Terms is severable. If any provision (or any part of any provision, including any word such as “negligence”, or any category of the Released Parties) is held invalid, void, or unenforceable, that provision or part will be severed or read down only to the minimum extent necessary, the remaining provisions and parts will remain in full force and effect, and the release, waiver, assumption of risk, and indemnity will continue to apply to the fullest extent that the law allows.
23. Consumer Protection Savings. Nothing in these Terms is intended to, or does, waive, limit, or exclude any right, remedy, warranty, guarantee, or protection that cannot lawfully be waived, limited, or excluded under the Consumer Protection Act, 2002 (Ontario) or other Applicable Law. Where any provision would otherwise conflict with such a right, that provision applies to the maximum extent permitted and is otherwise read down, and the remainder of these Terms continues to apply.
24. Amendments. The Organizer may modify these Terms at any time. Updates will be posted on the official Festival website and take effect on posting. Your continued participation after a change constitutes acceptance of the updated Terms.
25. Entire Agreement, Binding Effect, and Survival. These Terms, together with the Festival’s Waiver, constitute the entire agreement between you and the Organizer regarding risk, release, and liability, and supersede all prior representations. These Terms bind and benefit you and the Released Parties and your and their respective heirs, executors, administrators, estates, successors, and assigns. Sections that by their nature should survive (including Sections 1, 5–13, 18, and 21–23) survive your attendance, the close of the Festival, and any termination of your participation.
26. Acknowledgment and Acceptance. BY PURCHASING A TICKET, COMPLETING REGISTRATION, SIGNING THE FESTIVAL’S WAIVER, AND/OR ENTERING THE FESTIVAL GROUNDS, YOU CONFIRM THAT YOU HAVE READ AND UNDERSTOOD THESE TERMS IN FULL; THAT YOU HAD THE OPPORTUNITY TO OBTAIN INDEPENDENT LEGAL ADVICE; THAT YOU ARE AGREEING FREELY AND VOLUNTARILY; THAT YOU INTEND YOUR AGREEMENT TO BE A COMPLETE AND UNCONDITIONAL ASSUMPTION OF RISK, RELEASE, AND INDEMNITY TO THE FULLEST EXTENT PERMITTED BY LAW; AND THAT YOU ARE GIVING UP SUBSTANTIAL LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE.
